Naina N Patel v. The Secretary To Government

2022-12-08Honourable Mr Justice M. Sundar3 pages

in W.P.No.32980 of 2022 M.SUNDAR, J., This order will now dispose of captioned 'Writ Miscellaneous Petition' ['WMP'].

2. Captioned WMP has been filed with a prayer to dispense with production of original of the impugned notice i.e., notice that has been assailed in the main writ petition.

3. Mr.G.Gokul, learned counsel on record for writ petitioners in support of his contention, draws the attention of this Court to paragraph No.14 of the support affidavit which reads as follows: '14. I humbly submit that a copy of the impugned order namely, impugned G.O.Ms.No.53 Municipal Administration and Water Supply (MA.IV) Department dated 30.03.2022 and the Property Tax General Revision Notice 2022-2023 vide Notice No.II/1/22-23/1278338, dated 09.09.2022, passed by the 2nd respondent contains digital signature of the 2nd respondent, and served via post. Page Nos.1/3

Therefore, it will be in the interest of justice to dispense with the production of original impugned notice namely the Notice No : 1, Property Tax General Revision - 2022 - 23 dated 08.07.2022.'

4. Adverting to the support affidavit, learned counsel submits that the date of impugned notice has been wrongly given as 09.09.2022 and that the same should read as 08.07.2022. In this case, as an exception, request is acceded to in the fond hope that such errors do not recur in the days to come. It is also made clear that this order will not serve as a precedent in similar matters in days to come.

5. Be that as it may, considering the reason given which has been articulated nicely in paragraph No.14 (except the error in the date) this Court accedes to the dispense with prayer. Captioned WMP ordered as prayed for.
