This petition is filed under Section 17-B of the Industrial Disputes Act, 1947 for a direction to the respondent management to pay the last drawn wages of Rs.15,420/-.
2. The petitioner in his sworn affidavit has categorically stated that he is not gainfully employed and he was managing his expenses with the help of friends and relatives. The respondents has not filed counter denying the said averment.
3. The learned counsel for the petitioner states that he has claimed Rs.15,420/- as last drawn wage on the basis of the Minimum Wages fixed under the Minimum Wages Act.
4. The learned counsel for the respondent management on the other hand submits that the petitioner was paid wages at Rs.13,299/- per month as evidenced by the salary slip dated 30.06.2020. 1/3
5. It is seen that before the Labour Court, the petitioner did not dispute that an amount of Rs.13,299/- was paid by the respondent/ management. I am therefore of the view that the petitioner would be entitled to 17-B wages at Rs.13,299/- as a last drawn wages. The respondent/ management is directed to pay the last drawn wages of Rs.13,299/- commencing from this month and thereafter pay the said wages every month on or before 15th of every month till disposal of the writ petition.
6. The arrears of 17-B wages from the date of writ petition till the date of payment, shall be paid within a period of twelve 12 (weeks) from the date of receipt of a copy of this order.
This petition is accordingly allowed.
