M.Natarajan ... Respondent/Complainant This case came up for settlement before the Lok Adalat. Both the parties are present. The learned counsel for the petitioner is not present. Mr.T.G.Madhuvaneswaran, learned counsel for the respondent is present. After mutual discussion, negotiation, mediation and conciliation between 1/5

both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The respondent-M.Natarajan herein filed a case before the trial Court aggrieved by the non payment of the cheque amount of Rs.2,30,000/- by the petitioner herein. The trial Court convicted the petitioner. Therefore, the petitioner herein filed an appeal before the learned I Additional Sessions Judge, City Civil Court, Chennai. The learned I Additional Sessions Judge, City Civil Court, Chennai has confirmed the order passed by the trial Court. Hence, the petitioner/accused has filed the present revision before the Hon'ble High Court aggrieved by the conviction order passed by the trial Court as well as by the Lower Appellate Court.

2.The fact remains that the petitioner issued a cheque for a sum of Rs.2,30,000/- to the respondent herein. As the cheque amount was not paid, the respondent herein filed the case.

3.Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case as follows: 4.The petitioner/accused agreed to pay a sum of Rs.3,00,000/- (Rupees Three lakhs) in full quit. As a sum of Rs.2,20,000/- was already paid to the respondent, the petitioner has now agreed to pay the remaining amount of Rs.80,000/-. During the course of negotiation, a Demand Draft for a sum of Rs.80,000/- (Rupees Eighty thousand only) was submitted by the petitioner to the respondent. The petitioner has agreed to pay the 2/5

above amount to the respondent and the respondent has also agreed to receive the said amount which has been issued in the form of demand draft. Both the parties made a formal request to the National Lok Adalat to pass an award in terms of the above settlement. 5.As a result, the award is passed hereby in terms of the above compromise arrived at between the parties directing the petitioner herein to hand over the demand draft for a sum of Rs.80,000/- (Rupees Eighty thousand only) to the respondent.

6.Consequently, the Criminal Revision Case stands disposed of. The Court Fee paid by the petitioner to be refunded. The amount of Rs.80,000/- already paid by the petitioner while preferring the appeal before the Sessions Court to be refunded to the petitioner. The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
