This Criminal Original Petition has been filed to withdraw the case in Crime No.356 of 2022 pending on the file of the 2nd respondent and transfer the same to the file of the 3rd respondent.

2. The petitioner submitted that there was a house break and theft in the house of the petitioner on 05.09.2022 at about 02.00 pm. He further submitted that 13 3⁄4 sovereigns of gold and cash of Rs.5,500/- were stolen from the petitioner's house. First Information Report was registered on 08.09.2022 in Crime No.356 of 2022. Thereafter, there is no progress in the investigation. Therefore, this petition is filed.

3. The learned Government Advocate (Criminal Side) submitted that the respondent Police has started the investigation and took finger print of the accused from the house of the petitioner and sent it for analysis. The respondent Police is awaiting for the result of the report.

4. This Court finds from the submission of the learned Government Advocate (Criminal Side) that investigation in this case is in progress. Therefore, there is no need to transfer the case from 2nd respondent to 3rd respondent. 2/4
