Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the 1st respondent and the 2nd respondent to take immediate and effective action under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, particularly Section 23, to declare the fraudulent sale deed, document No.4771/2023 as null and void, initiate appropriate proceedings to recover and secure the life and property of the petitioner in accordance with the provisions of the said Act, and grant adequate protection to the 2/8
petitioner and his mentally challenged son from further harassment, threats, and coercion by respondents 5 to 9.

ORDER
The Writ Petition is filed for the relief of a Mandamus, directing the 1st respondent and the 2nd respondent to take immediate and effective action under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, particularly Section 23, to declare the fraudulent sale deed, document No.4771/2023 as null and void, initiate appropriate proceedings to recover and secure the life and property of the petitioner in accordance with the provisions of the said Act, and grant adequate protection to the petitioner and his mentally challenged son from further harassment, threats, and coercion by respondents 5 to 9.

2. The Writ Petition has been taken up by consent of both the parties.
3. Since no adverse orders are passed against the respondents 5 to 9, notice to them is dispensed with.
4. The petitioner is a senior citizen and a sole caretaker of his mentally challenged son. The petitioner is the owner of the ancestral property situate at Vriddhachalam, Cuddalore District, covered under Settlement Deed No.3087/1973. The petitioner survives solely on the rental income derived from the said property. It is submitted that in furtherance of a preplanned conspiracy, private respondents induced the petitioner to part with his property by making false representations and obtained his signatures on fraudulent documents (Doc.Nos. 271/2023, 329/2023, etc.,) culminating in the registration of a sale deed dated 10.08.2023 for a purported consideration of Rs.2,45,00,000/-. However, only a part payment of Rs.49,00,000/- was credited to the petitioner's account, while the balance of Rs.1,28,00,000/- remains 4/8
unpaid.
5. The petitioner would submit that he has been subjected to harassment and threats. Therefore, the petitioner lodged complaints before the District Collector and the Superintendent of Police. However, there is no response. The petitioner would submit that though he lodged a complaint before the 1st respondent, it is the 3rd respondent who is the competent authority to dispose of the petition in accordance with law.
6. Heard the learned counsels on the either side and perused the records.

Considering the facts and circumstances of the case, particularly the fact that the petitioner has lodged a complaint as early as on 23.09.2024 and the same is yet to disposed off, a direction is issued to the 3rd respondent to issue notice to all the concerned person / interested person and complete the enquiry and pass final orders on the 5/8
complaint made by the petitioner on 23.09.2024, within a period of 8 weeks from the date of receipt of a copy of this order.
8. With the above directions, the Writ Petition is disposed off. No costs.
