ORDER

The present writ petition has been filed seeking issuance of a Writ of Mandamus, to direct the 3 rd respondent to consider the application of the petitioner dated 26.07.2025 for revocation of his suspension, in terms of the directions issued by the Government of Tamil Nadu in G.O.Ms.No.81, Human Resources Management (N) Department dated 04.08.2022.

2. Heard Mr.M.R.Jothimanian, learned counsel for the petitioner and Mr.C.Selvaraj, learned Additional Government Pleader for the respondents.

3. The learned counsel for the petitioner would submit that the present writ petition has been filed only for a limited prayer, namely, to consider the representation of the petitioner dated 26.07.2025.

4. Per contra, the learned Additional Government Pleader for the respondents would submit that the judgments in Ajay Kumar Choudhary Vs Union of India and G.O.Ms.No.81, Human Resources Management (N) Department dated 04.08.2022 will not be applicable to the case of the petitioner, since the petitioner has been charged for an offence under Section 304 I.P.C. and not under the Prevention of Corruption Act.

5. Considering the facts and circumstances of the case and without going into the merits, a direction is issued to the respondents to consider and pass orders on the representation submitted by the petitioner on 26.07.2025 on its own merits and in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order.

6. In fine, the writ petition stands disposed of. However, there shall be no order as to costs.
