Prayer: Criminal Original Petition filed under Section 528 of B.N.S.S. to direct the third respondent herein to execute non-bailable warrant dated 10.01.2024 issued by the Judicial Magistrate No.1, Virudhachalam against the accused regarding to execute non-bailable warrant to secure the ends of justice. ORDER

This Criminal Original Petition has been filed by the petitioner to direct the third respondent herein to execute the non-bailable warrant dated 10.01.2024, issued by the learned Judicial Magistrate No.1, Virudhachalam against the accused/4 th respondent herein in STC No.893 of 2021.

2. The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that on earlier occasion also, non-bailable warrant of arrest was issued against the same accused/4 th respondent herein. Thereafter, the accused was secured on execution of non-bailable warrant. Subsequently, 2/5

the learned Magistrate released the accused on his own bond and thereafter, the accused failed to appear before the Court for hearing. Hence, once again nonbailable warrant has been issued against the accused/ 4 th respondent herein and the respondent police are in search of the accused.

3. Heard both sides and perused the materials available on record.

4. Considering the submissions of both sides, the respondent police is directed to execute the non-bailable warrant dated 10.01.2024 issued against the accused/4 th respondent herein in STC No.893 of 2021 by the learned Judicial Magistrate No.1, Virudhachalam, within a reasonable time.

5. With the above directions, this Criminal Original Petition is disposed of.
