C.M.P.No.24131/2019 C.M.P.No.24131 of 2019 in C.M.A.Sr.No.38140 of 2019 V. BHAVANI SUBBAROYAN, J., This Civil Miscellaneous Petition has been filed to condone the delay of 220 days in representing the above Civil Miscellaneous Appeal in CMA.Sr.No.38140 of 2019.

2.The petitioner is the first appellant in the main appeal and he has filed an application in W.C.No.160 of 2016(Old W.C.No.568 of 2015) before the Deputy Commissioner of Labour, Coonoor, Nilgiris claiming a compensation of Rs.20,00,000/- for the death of her husband one Sahul Ameed. The said Court has awarded a sum of Rs.4,70,982/-. 3.Further, the petitioner wanted to file an appeal but, for want of proper filing and corrections the Registry has returned the papers on 21.03.2019 and granted 10 days time. Further she could not find the original postal cover of the impugned order served to her, since she is illiterate and not aware of the Court proceedings. It is also stated that the even after hectic efforts she was not able to trace out the postal cover.

C.M.P.No.24131/2019 V. BHAVANI SUBBAROYAN, J., tsg 4.Thereafter, the appeal papers were represented on 06.11.2019. However, said action was not wilful or wanted and prays for condoning the delay of 220 days in representing the above Civil Miscellaneous Appeal in CMA Sr.No.38140 of 2019.

5.Satisfied with the reasons given in the affidavit, this petition is allowed with a cost of Rs.500/- (Rupees Five Hundred only) payable to the Clerks' Association, High Court of Madras within a period of one week from today.
