The petitioners/A1&A2, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 294(b),417 and 506(i) of I.P.C, in Crime No.52 of 2023 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the de-facto complainant had given a complaint that she was in relationship with first petitioner herein and the first petitioner had also tied thali and also had physical relationship On 28.09.2023 the de-facto complainant approached the 1st petitioner and he abused the de-facto complainant in filthy language and threatened with dire consequences. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioners are innocent persons. They have been falsely implicated in this case. Hence, he prays to grant to anticipatory bail to the petitioners. He further submits that the de-facto complainant has a history of giving complaint of similar nature and he also forwarded a copy of the F.I.R in Crime No.18 of 2018 also registered under Sections 417 and 506(i) of I.P.C. https://www.mhc.tn.gov.in/judis 1/2

The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the de-facto complainant approached the 1st petitioner and he abused the de-facto complainant in filthy language and threatened with dire consequences. Hence, he opposed for grant of anticipatory bail to the petitioners.

5.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and the nature and gravity of the offence committed by the petitioners, this Court is not inclined to grant bail to the petitioners.

7.Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Crl.M.P is closed.
