2.Learned counsel for 2nd defendant opposes this application that the delay intervened has hugely inconvenienced the 2nd defendant.

3.The panacea for procedural ill is a cost and this Court, therefore allows this application subject to proof, relevancy and admissibility, but upon the plaintiff paying a cost of Rs.2,000/- (Rupees Two Thousand only) to 2nd defendant.

4.Post the matter on 16.02.2023 under the caption "for reporting compliance".
