Prayer: Writ Petition Appeal under Clause 15 of the Letters Patent Act, against the interim order dated 16.10.2023 made in WMP.No.27703 of 2023 in WP.No.28176 of 2023.

J U D G M E N T

(Judgment was delivered by D.BHARATHA CHAKRAVARTHY, J.) This Writ Appeal directed against the interim order of the learned Single Judge dated 16.10.2023 in W.P.No.28176 of 2023 and W.M.P.Nos.27703, 29258, 29261 & 29266 of 2023. We see, the order under appeal is only an ad-interim order and the Writ Petition is further listed for hearing on 30.10.2023.

2.Mr.AR.L.Sundaresan, learned Additional Solicitor General of India appearing for the appellants submitted that even before the order under appeal was passed on 16.10.2023, on 15.10.2023 itself all the seats were filled. He would further submit that the learned Single Judge had given an interim direction to accommodate the writ petitioner without dislodging any other person and therefore, they are not in a position to comply with the same. The learned counsel for the respondent/writ petitioner submits that the matter stood adjourned from 13.10.2023 to 16.10.2023 only for the apprearance of Learned Additional Solicitor General.

3.Since the Writ Petition is posted for hearing on 30.10.2023, it would not be appropriate for us to interfere in the matter at this stage. The said fact placed by the learned Additional Solicitor General can also be brought to the notice of the learned Single Judge. 4.The learned counsel for the 1st respondent / writ petitioner also submits that in the meanwhile they will not press for the contempt action 3/6

against the appellants.

5.Placing the said facts on record, we dispose of the Writ Appeal, leaving it open for both sides to raise all contentions before the learned Single Judge, when the matter is taken up for hearing on 30.10.2023.
