The petitioner, who was arrested and remanded to judicial custody on 14.08.2024, for the alleged offence punishable under Sections 87,65(2), 64(2)(m) of BNS Act and Section 5(1),5(m),6(a) of POCSO Act,2012 in C.R.No.17 of 2024, on the file of the respondent police, seek bail. 2.The case of the prosecution is that the petitioner who is the neighbour of the victim girl has committed sexual assault on her and also threatened her with dire consequences. Hence the complaint.

3. The learned counsel for the petitioner would contend that the petitioner is an innocent and a false case has been foisted against him. He would further submit that the petitioner is no way connected with the said occurrence and he is in judicial custody from 14.08.2024. 4.The learned Government Advocate appearing for the respondent police would contend that that the the petitioner who is the neighbour of the victim girl has committed sexual assault on her and also threatened her with dire consequences. He further submitted that the investigation is at 1/3

initial stage. Hence, he opposed to grant bail to the petitioner. 5.Heard both side and perused the materials available on record. 6.Considering the gravity of offence and the investigation is at initial stage the matter requires further investigation, this Court is not inclined to grant bail to the petitioner at this stage. Accordingly, this Criminal Original Petition stands dismissed.
