..Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the respondents 1 to 3 to remove the encroachers from the land in Survey No.12A/2A situated in Velliyur Kuruvattam, Karikalavakkam village, Tiruvallur District, Tamil Nadu. ORDER
(Order of the Court was made by R.Suresh Kumar J.) The prayer sought for herein is for a Writ of Mandamus directing the respondents 1 to 3 to remove the encroachers from the land in Survey No.12A/2A situated in Velliyur Kuruvattam, Karikalavakkam village, Tiruvallur District, Tamil Nadu.
2. In respect of the land situated at S.No.12A/2A situated at Velliyur Kuruvattam, Karikalavakkam Village, Tiruvallur District, it is the case of the petitioner that the said land belongs to the Government ie., Poramboke land which is just adjacent to the petitioner's land and being used as ingress and egress to the petitioner's property. However, the private respondents 4 to 8 have allegedly encroached upon the said land by putting up some huts and therefore, in order to remove such encroachment, the petitioner has given a representation to the official respondents, especially the first respondent and since no action has been taken on the said representation, he has approached this Court with the aforesaid prayer.
3. Heard the learned counsel for the petitioner and the learned Government Advocate for the official respondents. In view of the order that is going to be passed, notice to the private respondents is dispensed with.
4. The land in question is claimed to be a Poramboke land as stated by the petitioner, which has to be verified by the respondents and in this regard, suitable action has to be taken by the authorities especially the second respondent by giving notice to the alleged encroachers including the private respondents and after giving notice to the respondents as well as the petitioner, if the second respondent finds that there is any encroachment in the Government land, suitable action can be initiated against them by the revenue authorities under the provisions of Act 3 of 1905. Such an action can be taken as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order.
5. With the above direction, this writ petition is disposed of. However, there shall be no order as to costs.
