O R D E R
The order passed by the second respondent in proceeding dated 27.09.2017 under Section 7A of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952, is under challenge in the present writ petition.

The petitioner filed a writ petition mainly on the ground that during the relevant point of time, the Central Government Industrial Tribunal was not functioning for want of appointment of Presiding Officer. It is an admitted fact that an appeal lies before the Tribunal against the order passed under Section 7A of the Act. Under these circumstances, this Court is inclined to adjudicate the merits raised in the present writ petition and all the grounds raised on merits shall be adjudicated by the respective parties before the Tribunal.
The writ petitioner is at liberty to approach the Tribunal and in the event of filing any such appeal, the Central Government Industrial Tribunal shall condone the delay and take the appeal on file and adjudicate the same on merits by affording opportunity to all the parties and decide the same as expeditiously as possible. The writ petitioner is permitted to file an appeal within a period of four weeks from the date of receipt of a copy of this Order. Till such time, the respondents are restrained from initiating any coercive action against the writ petitioner.
3. Accordingly, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
