ORDER

The case of the petitioner is that the respondent issued a notice dated 04.11.2019 to vacate the tea shop, run by the petitioner, since the land belongs to Government. Aggrieved over the same, the petitioner has come forward with the present writ petition.

2. At the time of hearing, none represented the petitioner.

3. Learned Additional Government Pleader appearing for the respondent would submit that in the event the petitioner files any reply to the aforesaid notice, the same will be considered and appropriate orders will be passed.

4. Heard the learned Additional Government Pleader appearing for the respondent and perused the materials available on record.

6. On perusal of the notice, it is clear that the petitioner has promised to vacate the premises after festival, but the same was not complied by him. If the said tea shop is the only livelihood to him, then he should have filed a reply to the aforesaid notice, by justifying why he is running the tea shop in the Government land. However, he has not filed any reply. Though there was no representation for the petitioner, considering the fair submission made by the learned Additional Government Pleader appearing for the respondent, this Court without expressing any opinion on the merits of the case, issues the following direction:

(i) The petitioner is directed to file a reply to the notice dated 04.11.2019 before the respondent within a period of eight weeks from the date of receipt of a copy of this order;

(ii) On such receipt, the respondent is directed to consider the same and pass appropriate orders on merits and in accordance with law, as expeditiously as possible.

With the aforesaid observation and directions, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
