This petition has been filed seeking to extend the time limit of two weeks stipulated by this Court in the order dated 24.07.2024 in Crl.M.P.No.2862 of 2024 in Crl.R.C.No.304 of 2024 to deposit a sum of Rs.1,50,000/- to the credit of C.C.No.7250 of 2014 on the file of learned Metropolitan Magistrate, Fast Track Court No.II, Egmore, Allikulam, Chennai.

2.This Court, by order dated 24.07.2024, granted suspension of sentence to the petitioners with conditions. Thereafter, on 27.08.2024 the case was listed under the caption for being mentioned, wherein, this Court had directed the petitioner to deposit 30% of the cheque amount to the credit of C.C.No.7250 of 2014 within a period of two weeks from the date of receipt of a copy of that order.

3.The learned counsel for petitioner submitted that the cheque amount is Rs.5,00,000/-. During the pendency of the appeal, the petitioners already deposited 20% of the cheque amount, i.e., Rs.1,00,000/-. Thereafter, they could not mobilise funds within the stipulated period. Now, they made arrangements and today produced a copy of the Demand Draft for a sum of Rs.1,50,000/- in favour of C.C.No.7250 of 2014. Hence, sought for extension of time to deposit the amount.

4.In view of the same, the petitioner is directed to deposit 30% of the cheque amount, i.e., Rs.1,50,000/- before the trial Court to the credit of C.C.No.7250 of 2014, within a period of three weeks from the date of receipt of a copy of this order and execute sureties. 5.The respondent is permitted to withdraw the 50% of cheque amount lying in the credit of C.C.No.7250 of 2014 by filing appropriate petition before the Lower Court.

6.Accordingly, this Criminal Miscellaneous Petition is ordered. 2/4
