Prayer: Writ Petition is filed under Article 226 to issue a Writ of Mandamus directing the 2nd respondent to survey and measure the petitioner's field boundaries subsequently transfer patta passbook in favor of him after sub division of a property comprised in survey No.67/3 measuring an extent of 0.46 cents situated at Kattukottai Village, Thalaivasal Taluk, Salem District, in pursuance of petitioner's application dated 10.10.2024.

O R D E R
The Writ Petition is filed seeking a mandamus to the 2nd respondent to survey and measure the petitioner's property and subsequently transfer patta in his name after subdivision.
2. The petitioner purchased the suit property on 18.10.2021 in S.No.67/3, measuring an extent of 0.46 cents situated at Kattukottai Village, Thalaivasal Taluk, Salem District, from one Azhagesan. However, the patta in respect of the property jointly stands in the name of Azhagesan and his brother. Therefore, the petitioner presented his application on 23.09.2024 to the 2nd respondent requesting survey and subdivision of the subject property along with the necessary charges. Thereafter, the petitioner submitted his applications on 04.10.2024 and 2/6
10.10.2024. However, there is no response from the respondents. Therefore, the petitioner is before this Court.
3. Heard the learned counsels on the either side and perused the records.
4. Considering the facts and circumstances of the case, mandamus is issued to the 2nd respondent to conduct survey of the petition mentioned property. The petitioner shall submit all the relevant records to show his title to the property and the 2nd respondent shall, after issuing notice to the adjacent land owners and interested parties, hold an enquiry and thereafter, proceed to pass orders either surveying and subdividing the property and transfer of patta in his name or rejecting the request. In the case of a rejection, a speaking order shall be passed. The aforesaid exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this order. 3/6
5. With the above directions, this Writ Petition is allowed. No costs.
