O R D E R

The present Criminal Original Petition has been filed seeking to quash the proceedings pending against the petitioners in C.C.No.926 of 2022 on the file of the learned Judicial Magistrate No.III, Salem District. When the matter was taken up for hearing today, the learned Additional Public Prosecutor submitted that all the witnesses have been examined in this case and the case now stands posted for questioning the accused under Section 313 Cr.P.C. and that the petition filed by the accused seeking to recall the witnesses is also pending. Taking note of the facts of the case and the submissions made by the learned Additional Public Prosecutor that the trial has already commenced and the witnesses have already been examined, this Court is not inclined to interfere with the trial proceedings at this stage. 2/4

Accordingly, the Criminal Original Petition stands dismissed. However, the petitioners are at liberty to raise all their grounds before the trial Court. Consequently, the connected miscellaneous petitions are also closed.
