This application is presented by the plaintiff to condone the delay of 391 days in filing the additional documents described in the schedule to the Judge's summons. In the affidavit in support of this application, it is stated that the additional documents could not be located at the time of institution of the suit and that the suit was filed on an urgent basis because of the lockdown due to the Covid-19 pandemic. It is further stated that these documents are necessary to effectively prosecute the suit.
2. Learned counsel for the defendant states that the belated filing of these documents has not been adequately explained by the plaintiff.
3. Upon considering the above submissions, this application is liable to be allowed albeit subject to the right of the respondents to raise objections. Accordingly, this application is allowed subject to the right of 1/2 https://www.mhc.tn.gov.in/judis
