O R D E R
This writ petition has been filed, directing the respondents to consider the petitioner's representations dated 17.10.2023 and 18.10.2023 and thereby direct the 2nd respondent to renew the petitioner's Aashrama Committee.
2. The case of the petitioner is that the petitioner is a Treasurer of Sri Poondi Mahan Attru Swamigal Ashramam Committee. The said Ashrama Committee is a registered society, under the Societies Registration Act, 1975 with Registration No.41/1985 dated 05.08.1985. The petitioner approached the 2nd respondent in person on 18.08.2023 with relevant accounts for renewal of the society, but the 2nd respondent directed the petitioner to submit the
statement of account for the year 2022-2023. Again on 17.10.2023, the petitioner applied for renewal of the society through online along with necessary fee and they have also acknowledged the same, but so far their society was not renewed. On 18.10.2023, the petitioner sent a reminder representation to the 2nd respondent through a registered post. However, the same was also not considered by them. Hence, the present writ petition is filed with the above said prayer.
3. The learned counsel for the petitioner would submit that this Court may issue a direction to the 2nd respondent to consider the petitioner's representation dated 17.10.2023 and reminder representation dated 18.10.2023 and pass orders within a reasonable time as fixed by this Court.
4. Per contra, the learned counsel for the 3rd respondent would submit that the 3rd respondent is a member of the society and he is performing the pooja continuously in Sri Poondi Mahan Attru Swamigal Ashramam Committee. There was a civil dispute between the petitioner and the 3rd respondent. Hence, before deciding the application made by the petitioner, this Court may issue a direction to the 2nd respondent to provide an opportunity of hearing to the 3rd respondent and pass appropriate orders.
5. Considering the limited request made by the petitioner and without expressing any opinion on merits of the case, this Court is inclined to direct the 2nd respondent to consider the petitioner's representation dated 17.10.2023 and reminder representation dated 18.10.2023, after affording an opportunity of personal hearing to both the petitioner and the 3rd respondent, and pass appropriate orders within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. With the above direction, this writ petition is disposed of. No costs. 27.10.2025 Index : Yes/No : Yes/No Speaking/non-speaking order uma To 1.The Inspector General of Registration No.100, Santhome High Road Mandavelipakkam, Raja Annamalaipuram Chennai-600 028.
