Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to issue the patta and consider the petitioners representation dated 31.10.2022 within a stipulated period that may be fixed by this Honourable Court. O R D E R
The prayer sought for herein is for a Writ of Mandamus directing the 2nd respondent to issue the patta and consider the petitioners representation dated 31.10.2022 within a stipulated period that may be fixed by this Honourable Court.
2. In respect of the landed property at S.No.187/1A at Thidumal village, Paramathivelur Taluk, Namakkal District the petitioner had filed a representation dated 31.10.2022 to remove the name of the 4th respondent, which, according to the petitioner, has been wrongly included in the patta and to issue patta in the name of the petitioner. The said representation having been received by the 2nd respondent, who in turn has sent a communication to the 3rd respondent on 29.09.2022 to inspect the property and to give a report, pursuant to which no action has been taken at the end of the 3rd respondent, hence the petitioner has moved the present writ petition.
3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.
4. Heard the learned Additional Government Pleader who would submit 2 / 4
that, pursuant to the directions issued by the 2nd respondent dated 29.09.2022 the third respondent would inspect the property and send a report to the 2nd respondent within a time frame, based on which the orders would be passed by the 2nd respondent on the plea of the petitioner within a time frame that may be stipulated by this Court.

Having regard to the submissions made by the learned counsel for both sides, especially the stand taken by the learned Additional Government Pleader, this Court is inclined to dispose of this writ petition with the following order: ●That there shall be a direction to the 3rd respondent to act upon the direction issued by the 2nd respondent dated 29.09.2022 and send a report within a period of four weeks from the date of receipt of a copy of this order to the 2nd respondent.
●On receipt of the same, the 2nd respondent shall pass orders on the representation of the petitioner within a period of four weeks from the date of receipt of such report.
