The learned counsel for the petitioner would submit that the trial court had dismissed the complaint for making a wrong representation ; that admittedly the petitioner was present and had filed a memo stating that he could not be present at 10.30 a.m. before the court as he had gone to take medication for diabetes and that the learned Judge erroneously came to the conclusion that the said memo was false. The learned counsel therefore would submit that the petitioner may be permitted to establish his case on merits.
2. This court finds force in the submission made by the learned counsel for the petitioner and hence this court is inclined to grant leave. Accordingly, leave granted.
3. Registry is directed to number the appeal and post for admission, if it is otherwise in order.
