The petitioner/A2, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 143, 448, 294(b), 324, 506(ii), 149 of I.P.C and Section 25(1-A) of ARMS Act, 1959 in Crime No.98 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner, had a relationship with daughter of the de-facto complainant who had already married another person. It is stated that the accused persons had unlawfully assembled together and trespassed into the complainant's residence and assaulted the complainant with wooden log and threatened the complainant with dire consequences by showing knife and thereby caused injuries to the de-facto complainant. Due to previous love affair, they had tried to take custody of the complainant's wife. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is innocent. He has been falsely implicated in this case. Hence, the petition has been filed seeking anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the co-accused had been taken into custody and released on bail. Hence, he opposed for grant of anticipatory bail to the https://www.mhc.tn.gov.in/judis 1/2

C.V.KARTHIKEYAN,J., nvi 5.Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and that the co-accused had taken into custody and released on bail, but that it is the petitioner's role which has to be examined and the conduct cannot be condoned and the nature of seriousness of the offence, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 07.11.2023 nvi Crl.O.P.No.24855 of 2023 https://www.mhc.tn.gov.in/judis 2/2
