JUDGMENT

(Delivered by the Hon'ble Chief Justice) We have heard Mr.B.Kishore, learned counsel for the appellant, Mr.P.Muthukumar, learned State Government Pleader, for respondent No.1 and Mr.R.Muniyapparaj, learned Additional Public Prosecutor assisted by Mr.Sylvester John, learned counsel, for respondent No.2

2. It is submitted by the learned counsel for the appellant that after the writ petition was filed, the appellant is evicted from the subject property.

3. The matter is sub judice before the learned Single Judge. As the learned Single Judge is seized with the matter, it will not be proper to now pass any interim orders more particularly when the appellant is already evicted.

4. It is for the parties to take appropriate steps in the pending matter before the learned Single Judge. All the contentions of the parties are kept open.

The writ appeal, accordingly, stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
