NIRMAL KUMAR CRIMINAL MISCELLANEOUS PETITION No.16378 of 2019 IN CRL.A.NO.421 OF 2018 G.KANNADASAN [ PETITIONER ] Vs STATE REPRESENTED BY [ RESPONDENT ] INSPECTOR OF POLICE, SPE/CBI/ACB CHENNAI, (R.C.MA1/2006/A/0042).

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition made pending appeal vide in Crl.M.P.No.9757 of 2018 in Crl.A.421 of 2018 order dated 24.07.2018 that the petitioner shall appear before the said court on the first working day of every English Calendar month at 10.30 a.m. Until further orders.[CRL.MP.NO.16378/2019] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.SHANKER, Advocate for the petitioner and of MR.K.SRINIVASAN special public prosecutor for CBI cases on behalf of the Respondent the court made the following order:- The petitioner was convicted by the Trial Court and against which he preferred an appeal in Criminal Appeal No.421 of 2018. The sentence was suspended by this Court in Crl.M.P.No.

9757 of 2018, dated 24.07.2018, with a condition to furnish two sureties each for a sum of Rs.1,00,000/- to satisfaction of the learned XII Additional Special Judge for CBI cases, Chennai and the other condition is to appear before the said Court on the 1st working day of the every English Calender month at 10.30 a.m. until further orders.

2. The petitioner has been complying with the above said conditions, for the last one year. Petitioner seeks relaxation on the ground that he is suffering from vertigo and his movement is impaired and with an assistance of his family members, only he is able to move. His health condition further deteriorating and seeks relaxation.

3. In fact one of the occasion he suffered sudden bout of vertigo and was unable to stand and get down. Thereafter his wife who accompanied him, taken her husband with assistance of some good Samaritans, to hospital.

4. Considering the same, the condition imposed as against the petitioner is modified to the effect that the petitioner shall appear before the XII Additional Special Judge for CBI cases, Chennai, once in six months, until further orders.
