O R D E R

This petition has been filed seeking direction to the respondents police to to remove the petitioner's name from the history sheet D3/R/19/16 of the third respondent police.

According to learned counsel for the petitioner there was only one case against the petitioner and that was also ended in acquittal. But, the respondent police is keeping the name of the petitioner in the history sheet mechanically, which has to be removed.

Learned Additional Public Prosecutor for the respondents would submit that admittedly there was only one case against the petitioner and no previous case pending against the petitioner. Heard the learned counsel appearing on either side and perused the materials available on record.

In view of the statement made by the learned Additional Public Prosecutor for the respondents that there is no previous case pending against the petitioner and there was only one case, the respondent police is directed to remove the name of the petitioner in the history sheet as prayed for. 2/4

With the above directions the writ petition shall stand allowed. No costs.
