Universities, 2019 of the Respondent, any University shall apply for reassessment after 1 year and before 3 years of its existing accredited cycle and the restriction specified in Chapter IV clause 3(b) of the same Manual applies only to the subsequent fresh cycle and thus the petitioner Institution is eligible for re-assessment of its cycle-2 accreditation valid till 27.03.
2024 and pass such further order (and) to issue writ of declaration to declare that the embargo placed on the number and period of inspection of the Higher Education Institutions by the Institutional Accreditation Manual for Self Study Report of Universities, 2017 and 2019, of the respondent is violative of Article 1991)(g) of the Constitutionof India and has to be read down in view of the UGC Recognition and Monitoring of Assessment and Accreditation Agencies Regulation, 2018, Categorization of Universities [only] for grant of Graded Autonomy Regulation, 2018 and Institution deemed to be Universities Regulation, 2019, and pass such further order (and) to issue writ of declaration declaring that Chapter IV Clause 3(b) of the respondent Manual, 2019, relates only to the time frame for making application from the 2nd cycle for accreditation/assessment and does not relate to reassessment and pass such further orders.
Prayer in W.P.No.28761 of 2022 Writ Petition filed under Article 226 of the Constitution of India to issue writ of certiorified mandamus, to call for the entire records relating to the impugned communication dated 18.08.
