Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 2 to 6 to remove the encroachment on the 30 feet road on the western side to eastern side comprised in Survey No.133/1A connecting the Thiruthuraipoondi to Thiruvarur in view of the petitioner's representation dated 05.11.2016 and 14.04.2017. ORDER
(Made by the Hon'ble Chief Justice) We have heard Mr.S.Arivazhagan, learned counsel for the petitioner, Mr.P.Muthukumar, learned State Government Pleader,
assisted by Mrs.R.Anitha, learned Special Government Pleader for the respondents 1, 3 to 6 and Mr.V.Jayaprakash Narayanan, learned counsel for the second respondent.
2. Learned State Government Pleader, on instructions, submits that survey was conducted and 11 encroachments were found. Notice under Section 7 of the Tamil Nadu Land Encroachment Act was issued. Thereafter, order under Section 6 of the Act was passed. Concerned persons filed appeal under Section 10 of the Act and the appeal is also dismissed. Further action would now be taken by the authorities.
3. In view of the above statement, this writ petition stands disposed of. There will be no order as to costs. (S.V.G., CJ.) (P.D.A., J.) 26.06.2023 Index :
