Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Fourth Respondent to take the appeal filed by the Petitioner as against the order passed by the Third Respondent, treating the date of receipt of the order by the Petitioner, i.e., on 03.01.2019, for the purpose of calculation of limitation period for filing the appeal.

O R D E R

The Fourth Respondent has filed Status Report stating that the Petitioner has not re-presented the papers of the appeal, which have been returned to him on 11.04.2019 and he has produced relevant records in proof of the same. 2.

In view of the same, Learned Counsel for the Petitioner seeks permission of this Court to withdraw the Writ Petition with liberty to workout his remedies before the Fourth Respondent and he has made an endorsement to that effect. 3.

Recording the same, the Writ Petition is dismissed as withdrawn granting such liberty. No costs.
