ORDER

This writ petition has been filed seeking to direct the 1st respondent to consider the petitioner's representation dated 06.08.2022 against the 3rd 1/4

respondent.

2. It is the grievance of the writ petitioner that the third respondent, who is the Secretary of Pappampatty Panchayat has been reinstated, despite, she has involved in irregularities and committed misappropriation of funds. Therefore, the petitioner has given a representation to the first respondent for taking action on 06.08.2022. However, the same has not been considered.

3. Heard both sides and perused the materials placed on record. It is relevant to note that the Executive Authority is the President, he is not made as party. This Court is of the view that if at all there are irregularities, it is for the Council to take a decision and pass the resolution and forward to the District Collector and not by way of a representation.

4. Accordingly, this writ petition stands dismissed. No costs. 28.07.2023 dhk Internet: Yes/No 2/4
