ORDER
This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.
This case is registered for alleged offence under Section 379 of the Indian Penal Code. The de facto complainant is present before this Court. He submits that inspite of the order that is passed for return of property, he could not produce any surety. Therefore, the vehicle is still in the custody of the Court.

3. The vehicle is ordered to be returned to the de facto complainant as is where is condition without insisting upon any further surety. It can be seen that there is no previous or subsequent case as against the accused. The case is pending at the summons stage. In view thereof .any further service of summons will impinge upon the right to speedy trial of the accused.
4. Accordingly, the case in C.C.No.371 of 2022 of Judicial Magistrate Court No.I, Chengalpattu Taluk, Chengalpattu, stands quashed. This Suo Motu Transfer Case is disposed of.
08.09.2025 grs electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
