ORDER

This Writ Petition has been filed for a mandamus seeking for a direction to the respondent to calculate the bond amount of the petitioner, from the date of demand, excluding the past service rendered by the petitioner in the respondent College.

2. Heard Mr.E.V. Chandru for M/s.Aruna Elango, learned counsel for the petitioner. Mr.Stalin Abimanyu, learned Additional Government Pleader, accepts notice on behalf of the respondents. By consent of both the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner is a Senior Assistant Professor working at Government Kilpauk Medical College, Chennai. He has submitted a resignation letter on 06.06.2022, requesting the respondent to accept his resignation since he is suffering from Chronic Bronchitis and he is not able to continue with his Government duty. In the said letter, he undertook to pay the applicable bond amount executed by him during his post graduation period.

The learned Additional Government Pleader appearing for the respondent, on instructions, would submit that the respondent is willing to accept the resignation letter of the petitioner and intimate him about the bond amount payable by him. The learned Additional Government Pleader requires four weeks time for the said process to be completed.

After recording the undertaking given by the respondent, this Writ Petition is disposed of, by directing the respondent to calculate the bond amount payable by the petitioner, from the date of demand, excluding the past service rendered by him in the respondent College and intimate the same to the petitioner, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said intimation, the petitioner shall pay the said sum to the respondent, within a period of two

(2) weeks thereafter. On payment of the entire amount demanded by the respondent, the respondent shall accept the petitioner's resignation unconditionally. No costs.
