The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 420 of IPC read with Section 66(D) of the Information Technology Act, in Crime No.120 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The learned counsel appearing for the petitioner would submit that this Court by order dated 04.01.2023 has granted an order of anticipatory bail with the following condition that "the petitioner shall deposit a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) to the credit of Crime No.120 of 2022 before the concerned Magistrate, at the time of furnishing sureties and the learned trial Judge shall disburse the amount to the defacto complainant on undertaking affidavit" and had directed the matter to be listed today i.e., 09.02.2023. He would submit that the petitioner has not complied with the condition as ordered by this Court.
