These petitions have been filed to substitute the legal heirs of the deceased first appellant as Respondents 18 to 22, to set aside the abatement and to condone the delay of 4073 days in setting aside the abatement.

2. This Court by an order dated 13.06.2023, ordered notice to the proposed respondents 18 to 22. Notice sent to the proposed respondents 18 to 22 have been served and their names have been printed in the cause list.

3. The learned counsel for the respondents submits that he has no objection in allowing these miscellaneous petitions.

4. Perused the affidavit filed in support of these petitions and satisfied with the reasons stated therein, These Civil Miscellaneous Petitions are ordered as prayed for.

5. The legal heirs of the deceased 1st appellant are brought on record as respondents 18 to 22 in A.S. No.947 of 2004.
