This petition has been filed to implead the petitioners 1 to 15 herein as party respondent Nos.4 to 18 in the above writ petition.
2. Heard the learned counsel for the petitioners and the learned counsel appearing for the respondents.
3. It is stated that these petitioners were sponsored through employment exchange and are working as Nurse/ Pharmacist /Dialysis Technician/ Hospital Orderly/ Receptionist in the respondent Port Trust Hospital and getting meager income. Their employment is termed to be on contract basis and that many of the vacancies which arose subsequently, have been filled up. It is also stated that they are under the direct control and supervision of the 4th respondent and their wages are being paid by the 3rd respondent Port Trust every month. In the said writ petition, this Court has also passed an order of injunction restraining the 4th respondent /Chennai Port Trust Hospital from terminating these petitioners. vsi -2petitioner was not taking legal course of action to bring the Management for negotiation and to get better service conditions of these 15 petitioners, the petitioners left the writ petitioner Union and became the members of Transport and Dock Workers Union and therefore, they may not be able to represent in the writ petition.
4. The learned counsel appearing for the respondents raised objection for impleadment of these petitioners in the writ petition.
5. Considering the submissions made by the impleading petitioners, this Court is of the opinion that the petitioners have to be impleaded as party to the writ petition. Accordingly, this implead petition is ordered.
6. Registry is directed to carry out necessary amendment in the writ petition.
