No. 34 / 2013 to 52 / 2013 and 1 / 2014 in nil date NMLA, LAC No. 1466 / 2014 to 1485 / 2014 in PDM E.P. Nos. 169 / 15 to 188/15 and quash the same Award related to Respondents and further Direct the Respondent herein to repay each Rs 5,000/- and totally Rs. 1,15,000/- for these cases with interest till the date of Realization with cost of this petition.

ORDER

(Order of the Court was made by S.M.Subramaniam J.) The Writ on hand has been instituted questioning the validity of the National Mega Lok Adalat award passed by the District Legal Services Authority, Villupuram.

The petitioner in person would submit that his signature before the Lok Adalat was obtained by coercion and at the instigation of a former Minister and therefore he challenged the Lok Adalat award. He would further submit that all the awards under challenge remain undated and on that ground also the award is to be invalidated.

A perusal of the Lok Adalat award would show that the proceedings were conducted through open Court hearing and all the parties including the writ petitioner, who was an accused signed the award and he also paid a sum of Rs.5,000/- in respect of each cheque issued by him and further he agreed to pay the balance amount within six months from the date of settlement. The learned Additional Government Pleader appearing for the respondent would submit that the balance amount has not been settled and separate proceedings are initiated to recover the said amount and execution proceedings are pending. She would further submit that to circumvent the execution proceedings, the present Writ Petition has been filed.

However, this Court is not inclined to go into the merits of the case as it is left open to the parties to adjudicate before the competent forum in the execution proceedings. As far as the allegation raised by the petitioner that his signature was obtained by coercion before the National Mega Lok Adalat is not established with any acceptable evidence, the same cannot be addressed upon. Regarding the payment of balance amount or otherwise it is to be adjudicated on merits before appropriate forum. In view of the above factum, this Court is not inclined to entertain the present Writ Petition. Consequently, the Writ Petition stands dismissed. No costs.
