ORDER

The allegations in this case are that on 13.08.2020, the accused protested against public and transport movement without due permission with a risk of spreading Corona disease. A case was registered in Cr.No.1467 of 2020 on 17.08.2020 for the alleged offences under Sections 341, 143, 269 and 278 of Indian Penal Code, 1860 r/w Section 3 of The Epidemic Diseases Act, 1897 and Section 51 of The Disaster Management Act, 2005. The final report was filed on 21.08.2020 and the accused have been facing trial since then. Thus, it can be seen that the allegations concern exercising the democratic right to protest. Given the context and nature of the allegations, continuing the trial impinges on the right to a speedy trial of the accused. No useful purpose will be served by continuing the case. 2. Accordingly, the S.T.C.No.99 of 2020 on the file of the Judicial Magistrate Court, Thirukovilur Taluk, Kallakurichi shall stands quashed and this Suo Motu Transfer Case stands allowed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
