Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents to issue separate patta in so far relate to land situated in S.No.12/2, Anukkumalai Village, Kilpennathur Taluk, Thiruvannamalai district to the extent of 2.85 acres along with S.No.11/4 to the extent of 20 cents and house building situated in Old S.No.75/1, New R.S.No.90/25, Neivanatham Village, Kilpennathur Taluk, Thiruvannamalai District to the extent of 2475 sq.ft to the petitioner by taking note of the registered documents in Document No.3419 of 2024 dated 04.09.2024 and another document No.3422 of 2024 dated 04.09.2024.

Since the petitioner's applications dated 27.09.2024 seeking to issue of a separate patta with reference to the property comprised in S.No.12/2, Anukkumalai Village, Kilpennathur Taluk, Thiruvannamalai District to the extent of 2.85 acres along with S.No.11/4 to the extent of 20 cents and house building situated in Old S.No.75/1, New R.S.No.90/25, Neivanatham Village, Kilpennathur Taluk, Thiruvannamalai District to the 2/5

extent of 2475 sq.ft., has not been considered by the 1st respondent, the petitioner is before this Court.

2.Heard the counsels on either side.

3.Considering the limited prayer that is sought and taking into account the fact that it is over a month since the representation has been made, a mandamus is issued to the 1st respondent to consider the petitioner's representation dated 27.09.2024 for separate patta after issuing notice to all the interest parties and pattadars, hearing their objections and thereafter pass orders. In case of a rejection a speaking order shall be passed. The said exercise shall be completed within a period of 12 weeks from the date of receipt of a copy of this Order.

4. With the above directions, this Writ Petition is allowed. No costs. No costs. Consequently, the connected Miscellaneous Petition is closed. 20.11.2024 (shr) Index : Yes/No Speaking Order: Yes/No 3/5
