This application has been filed under Section 151 CPC to exempt the petitioners from paying the Court Fee of Rs.3,62,969/-.

2. In paragraph 7 of the affidavit, it is stated that the entire land of the petitioners were acquired for the purpose of providing house sites and they are not in a position to pay the Court Fee as they are coolies.

3. However in the report filed by the Tahsildar dated 31.01.2020, it is stated that the first petitioner is owning lands in Survey Nos.37/2, 37/1A and 37/1C and he is also running a provision store and thereby earning Rs.15,000/- per month. In support of the report, statement of the Village Administrative Officer is also enclosed.

4. In the light of the above facts, this Court is of the opinion that the petitioners are not entitled for exemption of payment of Court Fee and hence, the petition is dismissed.
