ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for alleged offences under Sections 153A and 295A of the Indian Penal Code. The incident occurred on 27.08.2017. The allegation in this case is that the accused spoke in a public meeting in a manner to insult other persons and also caused rift between two religions. However, considering the nature of allegations, it can be seen that the it is nothing but a speech in a public meeting and there is no intention of causing rift between two religions. The accused is facing the proceedings from the year 2021. Any further continuation of proceedings would impinge upon his right to a speedy trial. 3. Accordingly, the case in C.C.No.117 of 2021 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
