C.M.P.No.25667 of 2023 C.M.P.No.25667 of 2023 in S.A.No.248 of 2022 P.T.ASHA, J., The above second appeal was originally filed by the plaintiffs 1 to 4, challenging the concurrent judgment and decree passed against them in a suit for partition filed by the respondents 1 to 3 herein and one Arumugam.

The suit in O.S.No.18 of 2012 which, was filed on the file of Subordinate Judge, Sathyamangalam, was dismissed by judgment and decree dated 22.08.2014 wherein the learned Sub Judge has held that the suit properties are the separate properties of the deceased Arumugam and the respondents herein.

This judgment and decree was taken upon appeal in A.S.No. of 2015 by the appellants before the III Additional District and Sessions Court, Gobichettipalayam. By judgment and decree dated 11.01.2017, the appeal was also dismissed and it is challenging this concurrent judgment and decree the above second appeal was originally filed by the appellants.

The present petition has been filed to transpose the appellants 2 to 7 as respondents 4 to 9 in the second appeal since the appellants 2 to 7 have settled their claim for the partition with the respondents/defendants.
