Crl. O.P. No.26165 / of 2024 P. DHANABAL.J., The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 420, 406 read with 34 of IPC, in Crime No.20 of 2024 on the file of the respondent police, seek interstate anticipatory bail.

The case of the prosecution is that the defacto complainant was doing business in the name and style of 'Thessaloniki Solutions' at Mumbai and he was also running business regarding lubricants grease etc., where the 1st petitioner is the authorized representative for SSP Enterprises and they entered into Memorandum of understanding through a deed dated 08.10.2022 and the materials were ordered to be supplied to the SSP enterprises, while so, an amount of Rs.25 lakhs was paid by SSP enterprises for purchasing of Rs.84,000/- litres of lubricant oil which is worth about Rs.1,64,53,920/- and the balance amount of Rs.1,37,53,920/- has not been paid by the accused. Hence the case.

3. Learned counsel appearing for the petitioners would submit that a false case has been foisted against the petitioners. The transactions

between the parties are purely civil in nature and the petitioners have nothing to do with the aforesaid alleged offences. The defacto complainant has not supplied the materials upto the mark and there was price negotiation taken place for the purchased materials. There was no dishonest intention to cheat the defacto complainant. The petitioners are now taking steps to file anticipatory bail before the Court at Mumbai. Hence, prayed to grant inter state anticipatory bail to the petitioners.

4. Though notice served to the 1st respondent, there is no representation. The learned Government Advocate appearing for the 2nd respondent has not seriously objected.

Taking into consideration the facts and circumstances of the case, that there are business transactions between the parties and the petitioners have to take steps for bail and they have to go to Mumbai, this Court is inclined to grant inter-state interim anticipatory bail to the petitioners for a period of six weeks to enable them to move the concerned Court.

6. Accordingly, interim interstate anticipatory bail is granted to the petitioners for a period of six weeks, on condition that the petitioners shall

surrender before the learned Judicial Magistrate, Sriperumbudur, Kancheepuram District, within a period of fifteen days from the date on which the order copy is made ready and the petitioners shall each execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within four weeks from the date of execution of bail bond, the petitioners shall approach the competent Court and seek appropriate relief.
