This Criminal Original Petition has been filed to transfer the Private Complaint in C.C.No.130 of 2017 on the file of the learned Judicial Magistrate Court, Palladam to any other Judicial Magistrate Court at any district in Tamil Nadu.

2.It is the submission of the learned counsel for the petitioner that petitioner is an Advocate and there are unfounded allegations have been made against her. She had only drafted the settlement deed as instructed by the father of the defacto complainant. She finds it difficult to face the trial in the Court, where she is practising.

3.When this Court expressed that this is not a ground for seeking transfer, 2/5

the learned counsel for the petitioner responded by saying that personal appearance of the petitioner was already dispensed with and she may be questioned during the frame of charges and under Section 313 Cr.P.C, in camera. The petitioner is directed to move an appropriate petition before the learned Magistrate for the aforesaid purpose. On filing such a petition, the learned Magistrate is directed to dispose the petition on merits and in accordance with law, considering the nature of allegations made in the complaint.
