PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to provide adequate police protection to the petitioner's family and to save and safeguard the land of the petitioner comprised in old survey No.167/2 new survey No.129/2, measuring to an extent of 2.41 acres situated at Pattanur Village, Vannur Taluk, Villupuram District, based on the complaint dated 10.10.2024 and the F.I.R in Crime No.622 of 2024 on the file of the third respondent.

O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, to direct the third respondent to provide adequate police protection to the petitioner's family and safeguard the petitioner's land comprised in old survey No.167/2 new survey No.129/2, measuring to an extent of 2.41 acres situated at Pattanur Village, Vannur Taluk, Villupuram District, based on the complaint dated 10.10.2024 and the F.I.R in Crime No.622 of 2024 on the file of the third respondent.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the official respondents and perused the materials available on record.

3. It is seen that the dispute between the parties is civil in nature. The Writ Court cannot conduct a roving enquiry and find out the correctness based on the right and interest over the property. The competent court is a Civil Court which can testify the veracity of the pleadings and the documents by way of oral and documentary evidence.

4. In view of the above, the Writ Petition is dismissed. However, the petitioner is at liberty to workout his remedy before the Civil Court, in the manner known to law. There shall be no order as to costs.
