The petitioner, who was arrested and remanded to judicial custody on 23.09.2023 for the offences under Sections 279 and 304(A) of IPC r/w Section 185 of Motor Vehicles Act, 1988, in Crime No.214 of 2023, seeks bail.

2.It is stated that the petitioner in a drunken mode had driven a JCB vehicle and dashed against the two wheeler bearing registration No.TN 91 Z 2289 causing death of the rider of the two wheeler. The complainant is a widow.

3.On the side of the respondent, it is stated that the certificate of drunkenness has been produced and in the certificate, it is stated that the petitioner could not even talk, could not even appreciate the objects and could not even stand or walk steadily and could not even recollect the past events.

4.It is thus seen that the petitioner had consumed alcohol before driving the vehicle and caused death of an innocent person. 5.Taking into consideration the seriousness of the offence, this Court is not inclined to grant bail to this petitioner. 6.Hence, this Criminal Original Petition stands dismissed. 08.11.2023 vkr 1/2 https://www.mhc.tn.gov.in/judis
