ORDER
This Writ Petition has been filed to quash the proceedings in Na.Ka.No.32/D1PS/BVN(.)/2022 dated 26.11.2022 and direct the respondents to give permission and police protection for conducting Rekla Race scheduled to held on 25.12.2022 at about 9.00 am to 12.00 pm between Servarayanpalayam, Bhavani to Oricheripudhur, Appakoodal Road in connection with the Diwali Festival Celebration at Bhavani Town, Erode District.
2. When the matter is taken up, the learned Government Advocate (clr.side) for the respondents submitted that the petitioner had issued show cause in Na.Ka.No.31/D1/PS/2022 dated 18.11.2022, directing the petitioner to furnish the details of his associations, number of Horses and number of 2/4
Jockeys proposed to participate in the Rekla Race. Since the petitioner did not furnish the aforesaid particulars, the respondents denied permission to conduct the Rekla Race.
3. In reply, learned counsel for the petitioner submitted that the petitioner is now ready to furnish the particulars, required by the respondents.
4. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondents.
5. Considering the rival submissions and that the petitioner seeks permission to conduct Rekla Race on 25.12.2022, the petitioner is directed to give a fresh representation to the second respondent. On such representation, the second respondent is directed to consider the representation of the petitioner on merits and in accordance with law. If permission is granted by the second respondent, necessary conditions may be imposed by following the guidelines in Rc.No.007301/Genl.I(1)/2019 dated 09.04.2019 for the smooth conduct of Rekla Race.
