The petitioner is an accused in Spl.S.C.No.57 of 2023, in which charges have been framed under Sections 5(I), 5(j)(ii) & 6 of POCSO Act, 2012, r/w Section 341 of IPC. Originally FIR in Crime No.01 of 2023 had been registered by the respondent. The petitioner was arrested on 03.01.2023.
2.It is stated that the victim child is aged 14 years and the petitioner is a married person.
3.It is stated that the trial is under way before the Special Judge for Exclusive Trial of Cases under POCSO Act, 2012, Vellore. The next witness to be examined is a Doctor with respect to the DNA test. 4.Since the trial is coming to an end, and is in the concluding portion, a direction is given to the Special Judge for Exclusive Trial of Cases under POCSO Act, 2012, Vellore, to endeavour to complete the trial in Spl.S.C.No.57 of 2023, provided the learned counsel for the
accused co-operates and cross-examine the witnesses without any unnecessary delay, on or before 31.01.2024.
5.With the above observations, this Criminal Original Petition stands dismissed.
