Today, the matter is listed under the caption 'for being mentioned' at the instance of learned counsel for petitioner. 2.

Considering the submissions made by the learned counsel for the petitioner, this Court directs the Registry to carry out the following corrections in the order dated 09.11.2023 and issue fresh order copy: - "After paragraph No.3 of the order should read as under:

4. The learned counsel for the petitioner pointed out that while disposing the application, the trial Judge erroneously made an observation that the impleading parties are having right over the property and such observation is unwarranted one at the time of disposing the impleading petition since the right of the parties can be decided only after adducing the evidence. C.R.P.No.4153 of 2023 and C.M.P.No.25336 of 2023 observation made by the trial Judge to that effect is ordered to be deleted.

3. With the above modification, all other portion of the order remains unchanged.
