A.No.8585 of 2019 in C.S.No.786 of 2018 N.SATHISH KUMAR.J., This application has been filed by the applicants to condone the delay of 182 days in representing the written statement in D.No.10924 of 2019.

2.It is the contention of the learned counsel for the applicants that despite service of summons, the respondents/defendants have not appeared and filed the written statement.

3.It is seen that this Court, by its order dated 24.07.2019, has ordered fresh summons to the defendants 1 to 3 returnable by 19.08.2019 as summons have not been served. AOS has not been filed whether to find out the summons were re-served or not. Accordingly, delay is condoned and this application is ordered. The written statement is taken on record.

4.Post the matter on 22.11.2019, for filing counter in A.No.6610 of 2019, finally.
