O R D E R

The petitioner has filed this writ petition seeking for issuance of a Writ of Mandamus to direct the first respondent herein to consider his representation dated 22.02.2025 and to conduct an enquiry against the encroachments made by the third respondent unauthorisedly in the lands belonging to Arulmighu Ammaneeswarar Thirukovil, Pollachi, within a time frame as stipulated by this Court.

2.The case of the petitioner is that he is the resident of Kottampatti Village, Pollachi District and he is the devotee of Arulmighu Ammaneeswarar Thirukovil for over 30 years and that the lands abutting the temple form part of the properties, belonging to the said temple. While so, the third respondent herein has illegally encroached upon 15 cents of the above land and has been in possession of the same for more than 20 years. Therefore, the petitioner has made a representation dated 22.02.2025 to the first respondent to conduct an enquiry against the encroachments made by the third respondent in the above temple lands. Since the said representation 2/6

has not been considered, the petitioner is before this Court. 3.Learned counsel for the petitioner would submit that the third respondent herein has illegally encroached the above temple and has been in possession of the same for several years. Therefore, the learned counsel for the petitioner prays for appropriate orders for removal of encroachment against the third respondent from the above temple. 4.Mr.N.R.R.Arun Natarajan, learned Special Government Pleader, who accepts notice on behalf of respondents 1 and 2, submits that after conducting a fair enquiry, the petitioner's representation dated 22.02.2025 will be considered and appropriate orders will be passed by the first respondent.

5.Considering the request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's representation dated 22.02.2025, on merits and in accordance with law and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order, after 3/6
